Jurisdiction: Wales
This page explains Article 9 of the Town and Country Planning (General Permitted Development) Order 1995 as it applies in Wales.

Article 9 is the final Article in the 1995 GPDO. It is mainly a historical housekeeping provision rather than a rule which decides whether development is permitted today.

When the 1995 Order came into force, Article 9 revoked the older statutory instruments listed in Schedule 3 to the extent shown there. That allowed the new 1995 GPDO to consolidate the permitted development provisions which had previously been spread across the 1988 General Development Order and a series of amendment Orders.

You can read the current Article 9 and Schedule 3 on legislation.gov.uk.

What Article 9 actually says

The provision is only one sentence. It says that the statutory instruments listed in column 1 of Schedule 3 are revoked to the extent specified in column 3.

Schedule 3 then lists the older General Development Order legislation which the 1995 consolidation displaced, beginning with the Town and Country Planning General Development Order 1988 – SI 1988/1813 and continuing through a series of amendment Orders made between 1989 and 1995.

The revocations are not all identical. Some instruments were revoked in full, while only specified articles, paragraphs or schedules of others were revoked.

Why Article 9 still appears in the Welsh GPDO

Article 9 did its main work when the 1995 GPDO came into force on 3rd June 1995. Its purpose was to clear away the older permitted development legislation which the new Order consolidated.

It remains part of the Welsh 1995 Order because Wales continues to use that Order as the legal foundation of its permitted development system.

England took a different route in 2015 and revoked the 1995 GPDO so far as it applied to England. Wales did not replace the 1995 Order and has instead continued to amend and modify it.

Does Article 9 affect a permitted development proposal today?

Normally, no. If you are trying to establish whether a current proposal in Wales is permitted development, Article 9 is unlikely to be the provision which decides the answer.

The practical rules sit principally in Article 3, the relevant Part and Class in Schedule 2, and any other applicable restrictions such as Article 4.

Article 9 is still useful when researching the history of a permitted development right, because it identifies the older legislation which the 1995 Order replaced.

The Articles are now complete

Article 9 brings the substantive Articles of the Welsh 1995 GPDO to an end.

The sequence is therefore Articles 1 to 4, Articles 5 and 6 which were later omitted for Wales, then Articles 7, 8 and 9.

The next stage of the Planning Geek Welsh GPDO project is to move into the Schedules, starting with Schedule 1 and working forward in order.
