GPDO Schedule 4: statutory instruments revoked in England

Schedule 4 of the Town and Country Planning (General Permitted Development) (England) Order 2015 identifies the 23 earlier statutory instruments revoked by Article 8 so far as they applied to England. It is a historical record of the move from the 1995 Order to the English 2015 Order.

The schedule does not grant permitted development rights. For a proposal in England today, use the relevant current GPDO Part and Class. The 1995 Order continues to apply in Wales, as amended by Welsh legislation.

Need help with permitted development?

Permitted development can avoid a full planning application, but only if the right applies and every relevant limit and condition is met. Planning Geek can check the planning history, Article 4 directions and other restrictions, and help with a lawful development certificate or prior approval where needed.

What Article 8 did

Article 8(1) revoked the instruments in the table below when the 2015 English GPDO came into force on 15th April 2015, but only in so far as those instruments applied to England. Schedule 4 includes the 1995 GPDO itself and 22 named amendments. Amendments made to the English 2015 Order after commencement have their own legislative history; use the GPDO timeline and the current legislation when researching a later date.

A narrow transitional saving in Article 8(2) kept the pre-amendment 1995 wording available for the development described in Article 6(2) of SI 2015/659. It related to specified changes from the former Class A4 drinking establishment use, where ministerial approval or notice predated 6th April 2015, and certain demolition where a prior approval event predated that date. Article 8(3) ended this saving after a three-year period from the commencement of the 2015 Order. It expired in April 2018, although the historic wording can still matter when checking development carried out during that period.

Using this list for historic planning research

First identify when the development took place or the relevant application was made. Check the GPDO wording in force at that time and any applicable saving, rather than assuming the 2015 wording applied earlier. The 1995 GPDO history and Planning Geek timeline can help establish the sequence. In Wales, start with the Welsh GPDO; Schedule 4 did not revoke the 1995 Order there.
